Terms of Service & Product Disclosure

1) What Fuse Does

Fuse helps you create, edit, and export subtitles for media. Some features run on-device; others may rely on Apple system frameworks available on your machine. Fuse is not a file-hosting service and does not publish your projects.

2) Plans & Features (Summary)

Fuse offers Free, Lite, Pro, and Lifetime licenses (Lite Lifetime, Pro Lifetime). Features may evolve; the in-app plan screen is the source of truth.

Notes:

  • Non-English export is a Pro feature (English export works on all plans).
  • VTT export is available on Lite & Pro (not Free).
  • Feature availability depends on your macOS version and Apple frameworks installed on your device.
  • We may change plan inclusions over time. Changes will be reflected in-app and on this page.

3) Purchasing, Billing & Apple Platform Terms

Purchases and subscriptions are handled by Apple’s in-app purchase system (StoreKit). By buying or using Fuse you also agree to Apple’s applicable terms.

  • Subscriptions (Auto-renewing): Lite and Pro are billed by Apple at the selected interval and renew automatically until canceled in your Apple ID settings.
  • Lifetime Licenses (Non-consumable): Lite Lifetime and Pro Lifetime are one-time purchases that unlock the corresponding plan’s features for the life of the app/account on supported devices.
  • Trials/Promos: If offered, trial length and pricing are shown at purchase time.
  • Refunds: Managed by Apple per App Store policies. We do not process payments directly.
  • Taxes & Pricing: Displayed in your local currency by Apple at checkout.

4) Your Content

You retain all rights in your media and subtitles. You grant us a limited, revocable license to process your files solely to operate app features you invoke (e.g., generating subtitles, exporting, translating…). We do not claim ownership of your content.

You are responsible for:

  • Obtaining the rights/permissions to process the media you import.
  • Ensuring your use complies with applicable laws and third-party rights (e.g., copyright).

5) Technology & Third-Party Frameworks

Fuse uses Apple frameworks and other system-level capabilities where available (e.g., on-device speech/translation APIs on supported macOS versions). Where translation is used, output is machine-generated and may contain errors. Always review before publishing.

  • Privacy by design: Projects are processed locally where feasible. Certain features may require calling Apple system services on your device; Fuse does not operate its own cloud for your files.
  • Connectivity: Some features may require an active internet connection (e.g., retrieving product info from the App Store).
  • System requirements: Features vary by macOS version and hardware support; see the in-app feature list for your machine.

6) Acceptable Use

You agree not to use Fuse to:

  • Infringe intellectual property or privacy rights.
  • Create or distribute unlawful, defamatory, or harmful content.
  • Reverse engineer, circumvent licensing, or interfere with app security.
  • Use automated means to abuse rate limits or exceed fair-use caps.

We may suspend or terminate access for violations.

7) Accuracy, Output, and Professional Use

Subtitle timing, transcription, and translations are generated by algorithms and may be imperfect. Fuse is provided for general productivity; it does not provide legal, medical, or professional advice. You are responsible for reviewing and correcting outputs.

8) Support & Updates

We provide updates and bug fixes at our discretion. Some updates may change or remove features, or adjust plan limits, to maintain quality and comply with platform policies. We aim to announce meaningful changes in-app and/or on this page.

9) Privacy Summary

  • Data we handle: Project files you open in Fuse (media, subtitles, metadata you enter), purchase state (from Apple), diagnostics you optionally share.
  • Storage: Files remain on your device unless you export or share them. We do not sell your data.
  • Analytics/Crash reports: If enabled, we may collect minimal diagnostics to improve stability.
  • Third parties: Apple (in-app purchases, OS services). We do not send your files to external vendors for processing.
  • Your rights: Depending on your jurisdiction, you may have rights to access, delete, or restrict processing of personal data. Contact us at support@getfuseapp.com.

10) Ownership & License

Fuse is licensed, not sold. Subject to these terms, we grant you a limited, nonexclusive, nontransferable license to install and use Fuse for personal or business use on Apple platforms you own/control. All rights not expressly granted are reserved by Rui Miguel.

11) Termination

You may stop using Fuse at any time. We may suspend or terminate access if you materially breach these terms or use the app unlawfully. Termination does not entitle you to a refund (handled by Apple per its policies).

12) Disclaimers

Fuse and all outputs are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

13) Limitation of Liability

To the fullest extent permitted by law, Rui Miguel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of Fuse. Our aggregate liability will not exceed the greater of (a) amounts you paid for Fuse in the 12 months before the claim, or (b) CAD $50. Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the maximum extent permitted.

14) Indemnification

You agree to indemnify and hold harmless Rui Miguel and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your content or your breach of these terms.

15) Changes to These Terms

We may update these terms to reflect changes in the app, our practices, or the law. We will note the Effective date above and may notify you in-app for material changes. Continued use after changes means you accept the updated terms.

16) Governing Law & Disputes

These terms are governed by the laws of Ontario, Canada, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of Toronto, Ontario, unless applicable law requires otherwise. You and we waive class actions to the extent permitted by law.

Subscriptions & Licensing Addendum

What you’re buying

  • Lite (subscription): Recurring, auto-renewing access to Lite features.
  • Pro (subscription): Recurring, auto-renewing access to Pro features.
  • Lite Lifetime (one-time): One-time unlock; same features as Lite subscription.
  • Pro Lifetime (one-time): One-time unlock; same features as Pro subscription.

Managing your subscription

Subscriptions are managed in your Apple ID settings. You can cancel future renewals at any time; access continues until the period ends.

Refunds

Refunds are handled by Apple per App Store policy. Contact Apple Support to request a refund.

Device & OS requirements

Some features (e.g., translation) require newer macOS versions and/or supported hardware. If a system API is unavailable on your device, the feature may not appear.

Acceptable Use & IP Notice (Short)

  • Don’t infringe copyrights or misuse third-party content.
  • Don’t attempt to bypass licensing, copy our proprietary designs, or reverse engineer our code.
  • You own your subtitles and media; we own the Fuse app, brand, and documentation.

Transparency Statement

  • Fuse processes your media locally where possible.
  • We rely on Apple’s purchase system and may use Apple frameworks on your device to provide features (e.g., translation).
  • We do not sell your data or use it to train external models.
  • If we ever introduce a cloud feature, we’ll disclose it clearly and give you a choice.

Privacy Policy

1) Information We Collect

  • Account & Purchases: We receive confirmation from Apple when you buy, upgrade, or restore a plan. We do not store your payment details — those are handled entirely by Apple.
  • App Usage Data: We may collect anonymized crash reports and performance metrics (if you enable sharing in macOS/iOS).
  • Project Data: Media and subtitles you work on remain on your device unless you export or share them. Fuse does not automatically upload your files to us or third parties.
  • Support Communication: If you email us, we will see the contact details and content you provide.

2) How We Use Information

  • To provide the app and enable your purchases.
  • To diagnose crashes and improve performance.
  • To respond to support requests.
  • To comply with legal obligations.

3) How We Do Not Use Information

  • We do not sell or rent your data.
  • We do not use your content to train AI models.
  • We do not show targeted ads.

4) Data Storage

  • Project files: stored locally on your device.
  • Purchase status: securely stored via Apple’s systems and in your app preferences (UserDefaults).
  • Crash/analytics data: handled by Apple frameworks (if you opt in).

5) Data Sharing

  • Apple: for purchases, App Store reviews, crash reports.
  • No other third parties receive your files or personal information.

6) Your Rights

Depending on your location, you may have rights to access, correct, or delete your personal data. Contact us at support@getfuseapp.com for such requests.

7) Children’s Privacy

Fuse is not directed to children under 13. If you are under 13, do not use Fuse without parental consent.

8) Changes

We may update this Privacy Policy from time to time. Updates will be posted here with a new Effective date.

Fuse is built on Apple frameworks and may make use of open-source components. Where required, we include attribution below.

  • We will cooperate with lawful requests from authorities where required.

You are responsible for complying with your local laws on software exports/imports.
